Guidance to determine if FLSA applies to you as an employer is available here: <\/span><a style=\"line-height: 1.4em;\" href=\"http:\/\/www.dol.gov\/elaws\/esa\/flsa\/scope\/screen24.asp\">www.dol.gov\/elaws\/esa\/flsa\/scope\/screen24.asp<\/a><span style=\"line-height: 1.4em;\">.<\/span><\/p>\n<hr \/>\n<p><strong>Which Employees must receive the notice?<\/strong><\/p>\n<p><strong><\/strong><span style=\"line-height: 1.4em;\">Employers must send the notice to each employee including part-time employees; however, a separate notice to dependents is not required.<\/span><\/p>\n<hr \/>\n<p><strong>What information is contained in the notice?<\/strong><\/p>\n<p><strong><\/strong><span style=\"line-height: 1.4em;\">Employers must inform employees about:<\/span><\/p>\n<ul>\n<li>The existence of an exchange and kinds of services provided by an exchange<\/li>\n<li>How an employee may contact the exchange for assistance<\/li>\n<li>If the value of the employer plan is below 60%, the possible eligibility for a premium tax credit \u00a0if the employee buys a qualified health plan (\u201cQHP\u201d)<\/li>\n<li>A statement telling the employee that if the employee buys a QHP, the employee may lose any employer contribution to any health benefits plan offered by the employer and that all or a portion of such contribution may be excludable from income for Federal income tax purposes<\/li>\n<\/ul>\n<hr \/>\n<p><strong style=\"line-height: 1.4em;\">When must the notice be delivered?<\/strong><\/p>\n<ul>\n<li><span style=\"text-decoration: underline;\">New Employees<\/span>: For each new employee at the time of hiring beginning October 1, 2013. (In 2014, the time of hiring means within 14 days of an employee\u2019s start date.<\/li>\n<li><span style=\"text-decoration: underline;\">Current Employees<\/span>: Employers are required to provide the notice no later than October 1, 2013.<\/li>\n<\/ul>\n<hr \/>\n<p><strong style=\"line-height: 1.4em;\">How must the notice be delivered?<\/strong><\/p>\n<ul>\n<li><span style=\"line-height: 1.4em;\">\u00a0<\/span><span style=\"line-height: 1.5em;\">In manner easily understood by an average employee<\/span><\/li>\n<li>By first-class mail<\/li>\n<li>Electronically, if the requirements of the DOL\u2019s electronic disclosure safe harbor are met<\/li>\n<\/ul>\n<hr \/>\n<p><strong>Is there a Model Notice?<\/strong><\/p>\n<p><strong><\/strong><span style=\"line-height: 1.4em;\">Yes, model language notice is available at <\/span><a style=\"line-height: 1.4em;\" href=\"http:\/\/www.dol.gov\/ebsa\/healthreform\/index.html\">www.dol.gov\/ebsa\/healthreform<\/a><span style=\"line-height: 1.4em;\">.\u00a0 There is one model for employers who do not offer a health plan and another model for employers who offer a health plan for some or all employees.\u00a0 However, the Massachusetts Health Connector intends to issue guidance specific to Massachusetts employers. HNE will update this FAQ once the Connector has issued its guidance<\/span><\/p>\n<hr \/>\n<p><strong>Does this notice impact any other notice requirements?<\/strong><\/p>\n<p><strong><\/strong><span style=\"line-height: 1.4em;\">Yes, the DOL has also provided revisions to the Model COBRA Election Notice. The COBRA notice is being revised to help make qualified beneficiaries aware of other coverage options available in the Marketplace.
